With laws being different from state to state – and with laws changing and people moving, the question “Is weed legal in my state?” is a common one. Here we cover all 50 states and Puerto Rico.
Weed Legality per State?
Weed has been used throughout the world for thousands of years, and evidence of smoking cannabis has come to light as pipes have been discovered that date back to centuries ago. Yet, our country’s relationship with marijuana has been a complicated one for the better part of the last century. However, more and more states have worked hard to legalize cannabis over the last few years, which means that now, in many parts of the country, you can legally enjoy your cannabis on your terms without risk of legal repercussion.
Anyone who has been paying attention knows that legalization laws across the states have been changing more rapidly than ever before, and it’s understandable if it’s hard for you to keep up. As we’re now well into a new year, we thought we’d make an up-to-date guide on weed laws per state, so that you know where you stand based on where you live.
Is Weed Legal Federally?
Marijuana has not been federally legal since the 1960s, when it was first criminalized, along with hemp. Hemp has since been legalized thanks to the 2018 Farm Bill, but marijuana remains illegal on a federal level due to its higher content of THC, a psychoactive compound that naturally occurs in the plant material. However, states are allowed to make their own marijuana laws, which is why many states have been able to legalize it. Further, medical marijuana is also federally illegal under state law.
Marijuana Laws According to State
This is the most up-to-date list of marijuana laws according to state, as of February of 2021. However, as we said, marijuana laws are changing fast, and so you should check up on your state laws in a few months to see if anything has changed. For the states in which legalization enactment is still pending, you may find that in a month or so the new laws have finally gone into effect. But we don’t recommend purchasing marijuana until this takes place if you live in one of these states.
Keep in mind that once again, marijuana laws have had a long and complex history in the United States for a long time now, but for cannabis lovers, hope is on the horizon. While it still remains federally illegal, weed is now legal in many states, and it’s expected that it will become federally legal at some point in the near future. For the time-being, if you do live in a state in which it remains illegal, you can face legal penalty for possession, so be mindful of your state’s laws before considering buying weed.
